ELD is an electronic logging device that is connected to a vehicle to automatically record driving hours for the purpose of preparing HOS reports. The ELD mandate affects almost 160 thousand commercial vehicle drivers in Canada. Motor carriers who operate between provinces are affected by the Electronic Logging Device Mandate. It applies to both commercial truck and bus operations. Drivers who only operate within a specific province have to follow provincial jurisdiction instead \u2013 meaning they do not have to comply with the new elog mandate. Yes. A registered vehicle\u2019s model year is established by the criteria set out by the National Highway Traffic Safety Administration (NHTSA). It is possible that the model year on the registration does not match the engine model year. This is commonly the case when the truck is reconstructed using a glider kit.\u00a0<\/span><\/p>\n

When this is the case, authorized safety officials should use the model year listed on the engine to decide if the driver must comply with the ELD mandate. In situations where the engine is older than year 2000, the driver does not have to follow the ELD rule.\u00a0<\/span><\/p>\n

In cases where the engine model year reflects that it was made in the year 2000 or later but the vehicle registration shows a model year older than 2000, the motor carrier must comply with the ELD mandate.\u00a0<\/span><\/p>\n

Drivers are not required to keep documentation that confirms engine model year. All information pertaining to the age of motors and engines must be kept at a motor carrier\u2019s main place of business. If the engine age cannot be determined on the side of the road, law enforcement should consider investigating the case further with the motor carrier.\u00a0<\/span><\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

Yes. Canada- and Mexico-domiciled drivers must keep up with the federal regulations and hours of service rules whenever they are doing business in the United States. These regulations include the use of electronic logging devices that are compliant with 49 CFR Part 395 unless they are exempt. Drivers who do business across multiple jurisdictions should be able to annotate their duty status on the device with any. The electronic logging device may customize the device to a customer\u2019s needs and specific operations to help them monitor their drivers\u2019 hours of service compliance depending on which country they are doing business in such as those who do business in both Mexico and the United States or Canada and the United States.<\/span><\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

Personal conveyance time is claimed by a driver when they are operating a vehicle for personal, not commercial, reasons. One example of this is when a driver is off duty and uses the vehicle to drive to a restaurant for a meal. In this situation, the United States is far less strict, placing no limitations on how far or how long a driver can drive. In contrast, Canada limits a driver\u2019s personal conveyance allowance to 75 kilometers (about 50 miles).<\/p>\n <\/div>\n <\/div>\n\n <\/div>\n\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

In the United States, drivers must take a 30-minute break after driving for eight continuous hours. Canadian drivers, on the other hand, are allowed 16 hours during which to complete their shift, with two hours of off-duty time. Drivers in Canada also have the flexibility to break up that time into either two single hours or four periods of 30 minutes if they do not want to take the two-hour break at once.\nAnother big difference is that a driver in Canada can choose to carry over unused off-duty time to the next day. When Department of Transportation officers in the United States need to access HOS information during inspections, they rely on ERODS (electronic records of duty status), which involves the use of a data repository that accepts four different transfer methods (e.g., email) to transfer elog information. ELD providers are mandated to support at least two transfer methods. Unlike in the United States, inspection officers can receive HOS information directly from the ELD via Transport Canada Servers. The FMCSA does not require ELDs to display the amount of time until the driver has to take a break.
