Do Fleets Need ELDs in Addition to GPS Tracking? 

The ELD mandate is a federal legislation aimed at drivers of commercial buses and trucks in Canada. Outside of the cases of exemption, drivers and carriers required to keep RODS will have to do so using an ELD system come January 1, 2023. Fleets composed of vehicles that engage in interprovincial commerce will require electronic logbooks unless one of the following exemptions applies: 

  • Special permit exemption. Special permits issued by government authorities allow vehicles to operate without being subject to the Canadian ELD mandate. 
  • Statutory exemption. Provincial or territorial offices can  issue statutory exemptions under which vehicles operate outside of the restrictions of the mandate. 
  • Up to 30-day rentals. Drivers operating vehicles under short-term rental contracts are exempt from the mandate, yet this exemption will not apply if the contract is renewed.
  • Manufacturing date. Vehicles manufactured before 2000 are exempt from mandate due to the fact that they cannot support ELD hardware. However, these vehicles must keep their RODS on paper logs.
  • 160-km operation radius. Drivers operating inside a 160 km radius are not required to keep RODS and, thus, are not subject to the ELD rule.

ELD Mandate Requirements

The ELD mandate is quite broad and comprehensive in its scope. Here, we summarize some essential requirements for electronic logging devices to be compliant: 

  • Limits on personal use. Drivers are allowed a strict distance of 75 kilometers for personal use.
  • Third party certification. ELD providers will need to pass the examination for certification by an authorized agency.
  • Duty status updates. The ELD must update drivers’ status automatically when one of the following occurs:
    • A speed of 8 km per hour or more is detected. Status must change to on-duty.
    • The engine stops for 5 minutes. The ELD must then ask the driver whether the status needs to change to “off-duty”. 
    • The vehicle is driven inside a customer’s yard.  The “yard move” mode must be activated to prevent the status from changing to “off-duty”.
  • Unassigned time management. Drivers will need to manage otherwise unassigned time accordingly. The ELD must enable drivers to make additions to the data kept in the logs so that inconsistencies and errors may be corrected.
  • Updated software. The electronic logbook must at all times be programmed to support current HOS and ELD rules and exemptions.
