Exemptions to the ELD Mandate and HOS Rules

The ELD mandate applies to the majority of the commercial carriers and haulers, including buses, trucks, and semi trucks that are required to keep RODS. However, there are limited exemptions, which include:

  1. Short-haul drivers.
  2. Drivers using paper RODs for not more than eight days every 30 days.
  3. Drivers of any commercial vehicles manufactured before 2000.
  4. Drive-away-tow-away operations drivers, as the vehicle towed is regarded as the product in transit.

Moreover, there are exemptions to the hours of service rules introduced by the FMCSA to aid improve safety on the roads.

  1. The 30-minute break rule applies to short-haul carriers qualifying under the provisions of the 100 air-mile radius and those who qualify for the provisions of the 150 air-mile radius but operating non-CDL vehicles.
  2. The 16-hour short-haul drivers’ exemption allows qualified drivers to extend the 16-hour driving window from 14 once in seven successive days.
  3. The adverse driving condition exemption allows carriers to add extra working hours to their maximum driving limit, provided the drivers or motor carrier could not predict the conditions before the trip started.
  4. The direct emergency assistance allows the driver to complete their journey in an emergency without violation of any provisions of the ELD mandate. Under this exemption, an emergency can only be declared by the FMCSA, State governors, or the President.
