Canadian Hours of Service ELD mandate

The Canadian ELD Mandate was created to improve driver safety as well as the safety of everyone else on the road. Overall, it will require certain commercial motor vehicle drivers to stop using paper logs, which are time-consuming and create room for error, and instead use electronic logging devices to record their hours of service (HOS) and records of duty status (RODS). Electronic logging devices can more easily keep track of whether drivers are adhering to the ELD hours of service rules in Canada regarding when to take breaks. They can also make inspections easier and more accurate for the drivers and inspectors. Most of the mandate is similar to the ELD Mandate set by the Federal Motor Carrier Safety Administration in the United States, but there are certain exceptions and differences. 

  • The proposed Canadian ELD Mandate was first published on Dec. 16, 2017, by the Canadian government, allowing for comments from stakeholders and the public by the end of the second quarter of 2017.
  • On June 13, 2019, Transport Canada released a final rule that commercial vehicle drivers will be required to start using ELDs instead of paper logs, unless they meet certain exemptions. 
  • By the enforcement date of June 12, 2021, affected drivers and carriers must all have begun using ELDs instead of paper logs. As such, carriers and drivers should already be familiarizing themselves with the mandate and begun the process of choosing a reliable ELD service provider.

It is important to note that, unlike the U.S. ELD Mandate that allowed a grandfathered period for fleets already using elogs to ensure compliance, the Canadian Mandate will not allow extra time for drivers to comply.

What is an ELD?

Essentially, an ELD is an electronic logging device that attaches to a vehicle’s diagnostic port and automatically records and logs the time a driver spends driving, among other things. Officially, Transport Canada’s definition of an ELD is “a certified device or technology that automatically logs the driver’s driving time and record of duty status.” 

The report created by the ELD is a replacement for paper logs, which are time-consuming to organize and analyze. The electronic submission of HOS makes the reports more accurate and imposes more accountability on drivers to make sure they’re taking their breaks as required and not spending so much time on the road that they become drowsy and accident-prone. And because ELD reports can be accessed on-site as well as remotely, the use of an ELD makes inspections easier to conduct and makes compliance easier for carriers. Plus, dispatchers can see in real time where their drivers may be at any given moment. 

Electronic logging devices were created in an effort to improve road safety by reducing driver fatigue. If a driver is driving for longer than the allowed time before taking a break, the ELD will record the fact that the driver was in motion and alert the driver that it is time to stop. If the driver keeps driving, their fleet manager can be alerted to the fact as well. Additionally, Transport Canada’s inspection officers can access the hours of service during roadside inspections. And since the ELDs provide an accurate representation of driver behavior, inspectors can be confident that the data from the ELD hasn’t been tampered with.

Not all ELDs are created the same. In fact, there are many companies that create ELDs and promise different features. Who Must Adhere to the Canadian  HOS ELD Mandate?

All in all, the Canadian ELD Mandate is expected to affect close to 160,000 commercial vehicle drivers across the country. Drivers who operate only within their home province will not have to abide by the mandate, as they’re bound by provincial regulations. However, inter-provincial drivers are held to federal regulations and, therefore, must comply with the Canadian Electronic Logging Device Mandate. This includes both commercial truck drivers and commercial bus drivers, unless they meet particular exemptions. 

Although drivers who operate within their home province do not yet have to follow the federal ELD Mandate, they should be aware of the fact that their province may at some point adopt similar guidelines. Becoming familiar with electronic devices now will help them not only prepare for any future regulations, but also benefit from the safety and ease of administration that ELDs provide. 

Canada ELD Mandate Exemptions 

Although the Canadian ELD Mandate will not be enforced until June 12, 2021, there are four main exemptions for certain commercial motor vehicles. Drivers will have to comply with the mandate if their vehicle:

  • Operates under a permit granted by an HOS director
  • Has a statutory exemption
  • Is being operated under a short-term rental agreement of fewer than 30 days (unlike the U.S. ELD Mandate, which states the short-term rental agreement must be no more than eight days)
  • Was manufactured before the year 2000
